Personal injuries occur in many different ways. Anyone can fall victim to automobile accidents, medical malpractice, nursing home abuse, unsafe property, dangerous products or criminal behavior. Injuries can range from minor to catastrophic - with traumatic brain injuries as a leading cause of death and permanent disability in the United States. Every year almost 1.5 million people in this country will suffer brain injury and nearly 2% of the population confronts daily life with TBI-related disabilities. Some of the more common TBIs include:
  • Closed-head injuries, or concussions, which occur when the head violently hits an object and the skull remains intact. Concussions are not generally considered life threatening, but they can have serious consequences (especially if the victim receives repeated brain injuries). Contre coup injuries are caused when brain cells are torn due to shearing forces.
  • Brain contusions that cause bruises and tears to brain tissue.
  • Penetrating head injuries are the result of an object piercing the skull and entering brain tissue.
  • Skull fractures occur when the bone(s) of the skull cracks or breaks, while depressed skull fractures are the result of the broken bones entering the brain.
  • Hematomas are dangerous blood clots that are pushed against the skull and cause pressure.
While some individuals immediately exhibit symptoms of TBI, others may not recognize the injury until days or weeks after the accident. Many times it's a friend, relative, or co-worker that spots the changes and makes the victim see the doctor. Symptoms of head injury may include headache, nausea, weakness, numbness, coordination and cognizance problems, confusion, personality changes, and seizures. TBIs can permanently affect cognition, movement, sensation and emotional health. Immediate treatment for the most severe head injuries may involve surgery to control bleeding and pressure in and around the brain.

Vehicle crashes involving cars, bicycles, pedestrians and recreational vehicles are the leading causes of traumatic brain injury, while firearms and falls also cause many TBIs. Other situations that cause TBIs include:

Sports-related accidents - these types of injuries are most often caused by diving accidents. If the accident occurred at a pool, the homeowners' or pool managers may be liable for damages.

Work-related injuries - victims of work-related TBI may experience disabling pain, motor skill problems, as well as mental and emotional problems that make them unable to perform job-related tasks.

Assault - crime victims are injured in violent attacks. While this is a criminal act, the property owners and management may also be liable for damages because of safety and security issues.

Slip and falls - falling on someone else's property or on a construction site may make the owners responsible for damages due to unsafe conditions or a failure to post warnings.

Children are susceptible to brain injury from poisoning by lead paint "dust" in older houses.

Product liability - if a defective or dangerous product caused your injury, the product manufacturer or distributor may be liable for damages due to inadequate labeling or defective manufacturing.

In Georgia, accident victims and their survivors are entitled to sue for damages including medical costs, lost wages, pain and suffering and property loss if someone's negligent actions (or lack of action) caused a personal injury. To receive a damage award, the plaintiff (the injured party) must prove that the defendant acted negligently and caused injuries to occur.
